Definitions
The cancellation, exchange, returns and refund policy between Seller and Buyer. Tungsten Innovation & Solutions Sdn Bhd with office located No.24, Jalan 6/91, Taman Shamelin Perkasa, 56100 Cheras, Kuala Lumpur (hereinafter referred to as “Seller”) and any person, body corporate or entity which purchases or order the products/goods from the seller website (hereinafter referred to as “Buyer”). The good(s) ordered by the Buyer, sold & delivered by the seller to the Buyer (hereinafter referred to as “Product”).
Clause 1
Once payment has been made, any cancellation will require seller approval with the exception of claims as per Clause 2.
Clause 2
In order for buyers to entitle for any claim, return or exchange, buyers must within five (5) working days after “Shipping Complete Date”**, report such request, subject to the following:-
a) Product is defective
A Product is defective if it :
i. is unfit for its intended use;
ii. not fit to be consumed;
iii. has a defective design;
iv. has been defectively assembled or manufactured ;
b) Product does not comply with description/criteria
A refund or exchange is allowed if the delivered product ;
i. is a different or the wrong product;
ii. has different specifications from that was ordered, such as different function, size or features;
iii. has missing parts;
** Shipping Complete Date” shall refer to the date the Product is delivered to, and received by the Buyer.
c) Otherwise, goods sold are not refundable.
Clause 3
Return of Product by Buyer – Buyer must deliver the Product to the Seller, unless the Seller waives the requirement for the Buyer to return the Product to claim for a refund. All costs and responsibilities to ensure products are in good conditions for such return delivery of the Product to the Seller, shall be borne by the Buyer unless Seller agrees to bear the same.
Clause 4
Upon receipt of the returned Product from the Buyer, the Seller shall review and check the same to assess whether it is in an acceptable and saleable condition for refund or exchange. The Seller is entitled to reject the refund or exchange of a Product that:
(i) has been consumed or is showing excessive wear and tear for the period of use;
(ii) has been used in a manner not fit for its purpose;
(iii)has torn or dirty packaging; and/or
(iv) is no longer in working condition.
Clause 5
Any request by a Buyer for refund or exchange of a Product due to Buyer’s change of mind, which is not due to any other reason (such as Product being defective), shall be subject to the Seller’s approval at all the time. The Seller is entitled to reject any such request by the Buyer in such instance.
Clause 6
Deliveries to West Malaysia will take around 7 working days upon receipt of full payment. Delivery time frames may change from time to time due to unforeseen circumstances. We will endeavour to provide the most up-to-date information for your order based on the consignment notes and/or consignment tracking details provided by our appointed delivery agent. A team member will contact you via your phone number as listed in your contact details where necessary. Please ensure your contact details are up to date. If a
team member has not contacted you by the expected delivery date, please contact us on 603-9281 1323.
